Kumamoto Agro Canvas Terms of Use

These terms and conditions stipulate the terms of use for the membership-based community service "Kumamoto Agro Canvas" (hereinafter referred to as "this service") planned and operated by Amakusa Nokobo Fao (hereinafter referred to as "our company"). When using this service, you must read the entire text of these terms and conditions and agree to these terms.

Regarding matters not specified in these terms and conditions,Terms of Use for Amakusa Farm Fao(hereinafter referred to as the "Original Terms") shall apply. In the event of any conflict between these Terms and the Original Terms, these Terms shall take precedence with respect to the use of the Service.


Article 1 (Contents of the Service)

  1. This service is a community service aimed at enabling members to learn, create, and foster connections with the local community through various activities provided by us, such as agricultural work experiences, event planning and participation, interaction between members, information exchange, and other activities.
  2. The Service includes, but is not limited to, the following:
  • Use of farms, facilities and online platforms managed by us
  • Participate in farm work and harvesting experiences
  • Events and workshops organized or participated in by members
  • Online and offline venues to promote communication among members
  • Providing information regarding this service


Article 2 (Members)

  1. "Member" in these Terms and Conditions refers to an individual or corporation that agrees to these Terms and Conditions and the Original Terms, applies to register to use the Service in a manner specified by us, and has been approved by us.
  2. When using this service, Members shall comply with these Terms and Conditions, the Original Terms and Conditions, and any other rules separately established by us.
  3. If a minor wishes to use this service, he/she must apply with the consent of his/her legal guardian, and consent from the legal guardian will be deemed to have been given at the time of the application.


Article 3 (Member's Responsibilities and Prohibitions)

  1. Members shall use the Service at their own risk and shall be fully responsible for all actions taken using the Service and the consequences thereof.
  2. In addition to the prohibited acts set out in the Original Terms and Conditions, Members must not engage in any of the following acts or acts that may be deemed to be such acts when using the Service.
  • Any conduct that significantly disrupts the harmony of other members, us, third parties, or the entire community of this service, including slander, harassment, intimidation, etc.
  • Collecting, disclosing, or providing personal information of other members without their consent.
  • Using information obtained through this service for purposes other than those of this service, or for commercial purposes (unless otherwise approved by us).
  • Damaging or defacing farms, facilities, equipment, supplies, etc. intentionally or through gross negligence.
  • Failure to follow our instructions regarding safety management when doing farm work, participating in events, etc., or engaging in dangerous behavior that endangers the safety of yourself or other members.
  • Impersonating another member.
  • Religious activities, political activities, or any similar activities (unless otherwise approved by us).
  • Any other conduct that we deem inappropriate and impedes the proper operation of this Service.


Article 4 (Handling of submitted information and deliverables)

  1. In principle, the copyright for any text, images, videos, ideas, plans, and other information (hereinafter referred to as "Posted Information") posted or provided by a Member in connection with this Service belongs to the Member who created the Posted Information or the original rights holder.
  2. However, the Member grants us the right to use (including copying, public transmission, exhibition, distribution, translation, adaptation, etc.) the posted information free of charge and non-exclusively to the extent necessary for the provision, operation, improvement, and publicity of the Service (including posting on related SNS and websites). This license shall remain in effect even after the Member cancels his/her membership.
  3. Members shall guarantee that the posted information does not infringe on the rights of third parties (including but not limited to copyright, portrait rights, privacy rights, and reputation rights, etc.). In the unlikely event that a dispute arises between a member and a third party in relation to the posted information, the member shall resolve the matter at his/her own responsibility and expense and shall not cause any inconvenience to us.
  4. If the Company determines that posted information violates these Terms of Use or is otherwise inappropriate, the Company may delete said posted information, in whole or in part, without notifying the Member.
  5. The handling of results (plans, designs, agricultural products, etc.) jointly created by members shall be decided through separate discussion between the members concerned, and in principle, we will not be involved. However, for projects in which we are involved or results that use our facilities and resources, we may decide how to handle them through separate discussion between the members and us.


Article 5 (Events and experience activities)

  1. Members may participate in events and experiential activities (hereinafter referred to as "Events, etc.") organized by us or other members.
  2. When participating in an event, you will be subject to the participation conditions, fees, cancellation policy, etc. separately determined by us.
  3. When participating in an event, etc., Members shall consider their own health condition, physical strength, etc., and participate only to the extent that they are able to.
  4. Members understand that agricultural work and nature experience activities are subject to the risk of weather and unexpected accidents and injuries, and they must take maximum consideration for safety. We will endeavor to manage safety, but we are not responsible for accidents, injuries, illness, theft, or other damages that occur during events, etc., unless we are guilty of intentional or gross negligence. Members are encouraged to purchase insurance at their own discretion, if necessary.
  5. When a member plans or hosts an event, he/she shall assume all responsibility for the planning and management of the event, including ensuring the safety of participants, obtaining necessary permits, etc. We may provide a venue or cooperate in advertising events hosted by members, but in principle we are not responsible for the content or management of such events.


Article 6 (Use of facilities and farms)

  1. Members may use the facilities and farms related to this service in accordance with the rules separately determined by us.
  2. When using the facilities and farms, members must keep them clean and be mindful not to cause a nuisance to other users.
  3. If you damage or lose any equipment or fixtures during your use of the facilities or farm, whether intentionally or through negligence, you must report this to us immediately and follow our instructions. Depending on the extent of the damage, you may be required to pay for repairs, etc.


Article 7 (Disclaimer)

  1. We make no guarantee, either express or implied, as to the completeness, accuracy, reliability, usefulness, etc. of the content of this Service.
  2. Any disputes that arise between members or between a member and a third party in connection with the use of this service shall be resolved at the member's own responsibility and we shall not be held responsible in any way.
  3. We shall not be liable for any damages suffered by members if the provision of this service is interrupted or delayed due to natural disasters, communication line failures, or other reasons beyond our control.
  4. We shall not be liable for any damages suffered by members in connection with the use of this service (including damages caused by computer virus infection), except in cases where such damages are due to our willful misconduct or gross negligence.


Article 8 (Changes to these Terms)

  1. If we deem it necessary, we may change these terms and conditions at any time without prior notice to members.
  2. The revised terms and conditions will come into effect from the time they are posted on an appropriate location on the website operated by us, and members will be bound by the revised terms and conditions. If a member does not agree to the changes, he/she should cease using the service and complete the cancellation procedure.


Article 9 (Possibility of Separation)

Even if any provision or part of any part of these Terms is deemed invalid or unenforceable under the Consumer Contract Act or other laws and regulations, the remaining provisions of these Terms and the remaining part of the provision that is deemed invalid or unenforceable shall continue to apply.completelyshall be effective on the


Article 10 (Governing Law and Jurisdiction)

  1. These Terms and Conditions shall be governed by Japanese law.
  2. In the event of any dispute between a Member and us regarding these Terms and Conditions or the Service, the Kumamoto District Court shall be the court of first instance with exclusive jurisdiction.
